POSSESSION OF CONTROLLED SUBSTANCES ARREST I On September 5, 2024, around 8:05 a.m., an officer observed a male slumped over the wheel of a vehicle parked in a parking lot. There was a glass pipe with white residue in the driver's lap, which was consistent with drug paraphernalia. The suspect was subsequently arrested for unlawful possession of controlled substances. A search of the truck revealed 6.6 grams of methamphetamine and more than 50 “Blues," which are counterfeit prescription pills containing fentanyl. The suspect was taken to jail on charges of Possession of a Controlled Substance Schedule II Felony and Possession of a Controlled Substance Methamphetamine Misdemeanor.
As of September 1st, possession of even small amounts of controlled substances is a crime (House Bill 4002). Those arrested for this crime will have the opportunity to join a Deflection Program lasting six months, in which they can receive treatment. If all terms of Deflection are met, there will be no criminal prosecution. Failing to participate in deflection will result in prosecution and possibly jail.
