The 9th U.S. Circuit Court of Appeals had directed all parties in the Oregon case to confer and report back by Wednesday on their next steps in light of last month's U.S. Supreme Court’s ruling in an Illinois National Guard case.

The federal government appears unwilling to drop its appeal of an Oregon judge’s injunction blocking the Trump administration’s deployment of National Guard troops to Portland, even after losing before the U.S. Supreme Court in a similar case in Illinois.
