Attorneys representing current and former members of the University of Oregon’s varsity beach volleyball and club rowing teams, who have filed a federal Title IX lawsuit against the school, filed three replies in opposition to UO’s motions seeking to dismiss or limit aspects of their case.
In the combined 72 pages of responses, attorneys representing the 32 athletes call UO’s motion for judgment on one of the claims “meritless,” contend similar motions for summary judgment related to a statute of limitations have been rejected by the Ninth Circuit and a recent U.S. Supreme Court decision outlines an ever longer standard, and the court “undisputedly has subject matter jurisdiction” despite the school’s motion to dismiss for lack of jurisdiction.
