***Senate Bill 48***

Here at the Coos County Sheriff’s Office, we often hear frustration and anger when it comes to who is held or who is not held. Often times we refer to Senate Bill 48 when it comes to who is released, or not released from the jail. In 2021 our legislature passed this bill and made it into law. The fact is, we don’t have a choice on who is and who is not to be held in the county jail. It is often claimed that the Coos County Sheriff’s Office is making excuses. To dispel that assumption, I am providing you with the law that we are required to follow. It should be noted that my provision of this information is not intended to either support or not support this law, but to educate the public on the realities of policing.
The text of the bill itself explains the process and includes when and how booking photos may be released to the public, as well as what conditions must be present to hold for those crimes which are releasable. The Release Guidelines Categorization List provides those crimes which the offender be released on without any other convictions or superseding crimes. Guideline 1 lists those crimes which an individual is released from the jail on their own recognizance with general conditions.
Guideline 2 specifies those crimes which the person is released under court imposed conditions which usually include some form of specificity on prohibited behavior, locations or associations.
Guideline 3 specifies those crimes where a suspect must be held until at least the first arraignment with other conditions.
