EUGENE — The attorney representing Daylen Austin is requesting the medical records for the deceased man involved in the fatal alleged hit and run last April and claims they will provide context for why the Oregon defensive back was “reasonably fearful and too afraid to remain at the scene.”
Bryan Boender, Austin’s attorney, filed a motion for pretrial production of medical records in Lane County Circuit court on Thursday. Boender claims the medical and mental health records of Frank William Seaman, whom Austin fatally struck with his SUV on April 15, are “favorable evidence that more fully explains his aggressive mental state at the time he threatened Daylen Austin with a hammer” in the moments preceding the fatal incident near the intersection of West Fourth Avenue and Polk Street.
